Safety first: weysail is a racing aid, not a navigation system. It can't replace a proper lookout, official charts, or the skipper's judgement. GPS positions and compass headings can be wrong.
About these terms
These terms cover your use of the weysail app (weysail:race and weysail:racepro) and this website. The app is provided by Everthere Ltd, company number 04546865, [registered office address]. By using the app you agree to these terms. Google Play's terms also apply to downloads and purchases.
Your licence
We give you a personal, non-transferable licence to use the app on devices you own or control. Please don't copy, resell, or reverse-engineer the app except where the law allows it.
Using weysail safely
- You're responsible for the safe navigation of your boat and for following the collision regulations and your sailing instructions.
- Check mark positions against your sailing instructions before racing. A mistyped or imported position will take you to the wrong place.
- Bearing, distance and VMG come from your phone's GPS and sensors, or from an external GPS. They can be inaccurate, delayed or unavailable.
- Don't use the app while it distracts you from keeping watch or handling the boat.
:racepro subscription
- :racepro is an annual subscription bought inside the app through Google Play. The price is shown before you confirm.
- It renews automatically each year unless you cancel at least 24 hours before the renewal date.
- To cancel, open Google Play, then Profile → Payments & subscriptions → Subscriptions, or use Settings → Manage Subscription in the app. Cancelling stops the next renewal. You keep :racepro until the end of the period you've paid for.
- Refunds are handled by Google under the Google Play refund policy. Contact us if something has gone wrong and we'll help.
- If you change phones, use Settings → Restore Purchases while signed in to the same Google account.
Nothing in these terms affects your statutory rights as a consumer.
Your marks
Marks you create or import belong to you and stay on your phone. Make sure you have the right to use any mark files you import. Back up important marks with Share or Save, because uninstalling the app deletes them.
Changes to the app
We may update, improve or remove features. If we take away a significant :racepro feature during a period you've paid for, we'll tell you in advance and you can cancel.
Our liability
We provide the app with reasonable care and skill. We're not responsible for losses that weren't foreseeable, for business losses, or for race results. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit.
Law
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings there.
